DMCA Notice

1. Introduction

ThreadLock respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to valid notices of copyright infringement.

2. DMCA Notice of Infringement

If you believe that content available through the ThreadLock Service infringes your copyright, you may submit a DMCA takedown notice. To be effective, the notice must include the following information:

Required Information:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of where the material that you claim is infringing is located on the Service, with enough detail that we can find it (e.g., URL, account identifier).
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. How to Submit a DMCA Notice

4. Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material
  • Provide the user with a copy of the notice
  • Take appropriate action against repeat infringers, including account termination

5. DMCA Counter-Notice

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notice. To be effective, a counter-notice must include:

Required Information:

  1. Your contact information: Your name, address, telephone number, and email address.
  2. Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  3. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which ThreadLock may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  5. Signature: A physical or electronic signature.

6. How to Submit a Counter-Notice

Send your counter-notice to the same Copyright Agent address listed above, with "DMCA Counter-Notice" in the subject line.

7. Our Response to Counter-Notices

Upon receipt of a valid counter-notice, we will:

  • Forward a copy of the counter-notice to the original complaining party
  • Inform them that we will restore the removed material in 10-14 business days
  • Restore the material unless the copyright owner files a court action seeking an injunction against the user

8. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, ThreadLock has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

9. False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.

Similarly, a user who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability.

10. User Responsibility

Users are responsible for ensuring that content they upload does not infringe on the copyrights of others. By uploading content to ThreadLock, you represent and warrant that:

  • You own the content or have the necessary rights to upload it
  • The content does not infringe on the intellectual property rights of any third party
  • You have obtained all necessary permissions and licenses
